OUR COMMITEMENT TO PRIVACY

Your privacy is crucial to us and we will not compromise on that. FANCHALLENGE (“we” or “us” or “our”) has devised this privacy document to inform you about our practices regarding the personal information we gather from users of our mobile application (“FanChallenge”, “Application”, “App”, “Services”). This notice does not apply to applications or services that do not display or link to this statement or that display or link to different privacy statements.

THE INFORMATION WE COLLEC

Information You Provide to Us

• We can be collecting some personal informal from you like your first name, last name, username, password, email address, country and state you live in when you create account to log in to our network (“Account”).

• If you are using our Application on your mobile device, we may be collecting your phone number and unique device Id number.

• If you contact us via email or give us feedback, we will collect your name and email address. Plus, the content you write in your email to send you an adequate reply.

• We will collect your user name and profile picture that you’re going to upload to your public profile page (“Profile”). In future, when you create a challenge or participate in any, other participants in the Challenge (each, a “Challenger”) will be able to see the information you have provided in your profile.

Information Collected via Technology

• Information Collected by our Services: In order to improve our services for you, our Application automatically tracks some certain information about the visits to our App. That includes your browser type, your operating system, Internet Protocol (IP) address, domain name, and or a date/time stamp for your visit. We use this particular information to examine trends, and collect demographic information. We will know about our user base and this helps us improve our services and for product development purposes as well. For instance, we collect some of the information so that when you come back to us, it will help us recognize and show you information accordingly.

• Cookies: We use cookies, like many other online services, to collect information. “Cookies” are like a small block of information that a website sends to your internal storage when you’re visiting the application. We may use both session Cookies and persistent Cookies to make sure a highly dynamic and personal customer experience. This information is collected to improve our Services and meet your expectations from our Application.

• Mobile Services: We may also gather some non-personal information from your mobile device if you have downloaded our Application on your device. This collected information is normally used to help us render the most relevant information to you. This information includes how to you use the Application, and information about the type of device you use. Moreover, if our Application crashes on your mobile device, we will receive the information about your mobile device model, software version, and device carrier that allows us to identify and fix bugs, all just to improve the performance of our Application.

• Third Party Analytics: We use a number of thirty party service providers like Google Analytics that help analyze how users use our services (“Analytics Companies”. All the Analytics companies use Cookies to pile up information. We use this information we receive from Analytics Companies just to improve our Application and Services.

Information Collected from or About Friends

• Refer-a-Friend: To join Fun Challenge, our Service may enable you to invite your friends. You can invite your friends via text message. We apply different techniques that enable you to invite your friends via text message, we also offer contact importer tools for this purpose. It will also import contacts from your address book so that you can swiftly and quickly ask your contact to join the Services and communicate with you. With your granted permission, we will access your address book, import names of your contacts, phone number, and any other information which can be used to determine your friends who have not been registered to the Application. A text message sent to your friends will go from your phone number so that your friends know that you desire to invite them to visit the Application. Similarly, in the process, we may collect your phone number to deliver you a text message for account verification purposes. Along with that, we collect information about some settings that help us interpret your data, such as the language and keyboard settings, phone’s carrier, mobile network, and mobile country code.

• Find a Friend: Our Services may enable you to invite your friends who already have an account to join a Challenge. To invite friends with Account to a Challenge, you either have to enter your friend’s username or use our contact importer tool to import and search through your contact (including contacts in your address book) to match those who are also registered users of our Application. If you grant permission, we will access your address book and import names of your contacts, location, and any other information to facilitate automatic connection with your friends.

INTERACTION WITH THIRD PARTY SITES AND SERVICES

Some services or other materials shown on the Application may integrate, be integrated into, or be provided connection with third-party services. We do have any control over those third-party service providers and our TERMS of Use and Privacy Notice does not apply to those third-party services. You must read the terms of use agreements and privacy policies that take effect on third-party services. FANCHALLENGE is not responsible for the practices used by any third-party websites or services linked to or from our website, including, without limitation, the information or content they have. Plus, you agree to that we are not responsible and do not have any control over third-parties and information you provide them. If you are using a third-party website or service and you give them access to your personal information, you do that at your own risk.

HOW WE USE INFORMATION

General Use: Generally, the personal information we collect or you submit to us is used either to respond to your requests or improve our customer experience. We use your personal information in the following ways:

• To facilitate you in your account creation process and then secure it on our network.

• To actually improve the quality of experience upon every interaction with our Application and Services.

• To respond to your inquiries and other requests.

User Feedback: We may post user feedback on the Website from time to time. We will share your feedback with your first name and last initial only. If we choose to post your first and last name along with your feedback, we will obtain your consent prior to posting your name with your feedback.

Creation of Anonymous Data: We may generate anonymized data (data that is not reasonably associated with or linked to any data that would reasonably be expected to allow someone to identify you or contact you) from personal information by excluding information (such as your name) that makes the data personally related to you. We use this anonymized data to analyze request and usage patterns so that we may enhance the reach and quality and content of our Services. We reserve the right to use anonymized data for any purpose and disclose anonymized data to third parties for any reason.

DISCLOSURE OF YOUR PERSONAL DATA

We disclose your information as properly described below and as described elsewhere in this notice.

• Third Parties Designated by You: When you use the Services, the personal information you provide will be shared with third parties that you designate to receive such information. For example, you may select to communicate with users who are participating in the same Challenge as you.

• Profiles and Players: When you participate in any Challenge, we may make your Profile available to other Players of the Challenge and enable you to communicate with other Players, in which case your communications will be disclosed.

• Friends: We may disclose information about you in connection with our Refer-A-Friend and Find-A-Friend programs as we have explained above.

• Social Networking Sites: Our Services and Application may enable you to post content to Social Networking Sites (e.g., Facebook, Twitter). If you choose to go with this, we will provide information to those websites according to your selection. You acknowledge and agree to that you are exclusively responsible for your use of those websites, it is your core responsibility to read and review the terms of use and privacy policy of third-party provider of those websites. We will not be responsible or liable for: (1) the availability, authenticity, or accuracy of such websites, (2) the content, services, or products of such websites, or (3) the way you use those sites.

• Other Disclosures: Irrespective of the choices you make regarding your personal information, FANCHALLENGE may divulge personal information if such disclosure is essential (A) to comply with relevant laws or to respond to warrants served on FANCHALLENGE, (B) in connection with any legal investigation, (C) to defend or protect the rights or property of FANCHALLENGE, and/or (D) to investigate or support in preventing any violation or potential violation of law, this notice or Terms of Use.

YOUR CHOICES REGARDING YOUR INFORMATION

• Changing or Deleting Your Personal Information. You may change any of your personal information in your Account by editing your "personal information" within your Account or by sending an email to us at the address given below. You may request deletion of your personal information by us, and we will use commercially reasonable efforts to honor your request, but please note that we may be required to keep such information and not delete it (or to keep this information for a certain time, in which case we will comply with your deletion request only after we have fulfilled such requirements). When we delete any information, that data will be anonymous.

CHANGES AND UPDATES TO THIS PRIVACY POLICY

This notice may be revised periodically, and if we make any material changes in the way we use your personal information, we will surely notify you. Any changes to this privacy notice will be effective upon thirty (30) days following our posting of notice of the changes on our Website. These changes will be effective immediately for new users of the Service and for all users who expressly acknowledge that this notice has been changed. Please note that at all times you are responsible for updating your personal information to provide us with your most current email address. In the event that the last email address that you provided us is not valid, or for any reason is not capable of delivering to you the notice described above, in the event that we elect to provide you notice via email, our dispatch of the email containing such notice will nonetheless constitute effective notice of the changes described in the notice. If you do not wish to permit changes in our use of your personal information, you must notify us prior to the effective date of the changes that you wish to deactivate your Account with us.
